1. Overview
Please read these Terms of Service ("Terms") carefully before using the Petit Auteur mobile application (the "Service") operated by Fairy ("us", "we", or "our").
By accessing and using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not access the Service.
You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, and you also should not try to translate the app into other languages or make derivative versions.
2. User Information
2.1 Data processing
The Petit Auteur app stores and processes personal data that you have provided to us, to provide the Service. It is your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Petit Auteur app won't work properly or at all.
2.2 User-Generated Content
You are solely responsible for any content you create or submit through the Service, including, but not limited to, text, images, audio, video, and any other material ("User-Generated Content"). By submitting User-Generated Content, you grant us a worldwide, non-exclusive, royalty-free, sublicenseable, and transferable license to use, reproduce, distribute, and display such content in connection with the Service and our business.
You agree not to submit any User-Generated Content that:
- Infringes on any intellectual property rights, including but not limited to, copyrights, trademarks, patents, or trade secrets;
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable;
- Violates any applicable local, state, national, or international laws or regulations;
- Contains software viruses, malware, or any other harmful computer code.
We reserve the right to remove any User-Generated Content that we determine, in our sole discretion, to be in violation of these Terms.
3. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
4. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
5. Limitation of Liability
In no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.
7. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
